Covenant

All properties at Mayfair Gardens are protected by a covenant written into Land Registry records.

Purchasers of properties at Mayfair Gardens must register as members of Mayfair Gardens Management Company as a condition of purchase and agree to observe and perform the covenants, conditions and stipulations covered by covenant.

Upon signing the Deed of Covenant and paying the Registration Fee a Certificate of Membership of the Company will be issued which enables owners to receive notification of, attend and vote at General Meetings of the Company.

The covenant protects the peaceful nature and uniformity of appearance and is formed of 5 schedules:

Grant of Easements

The first schedule covers rights of access to Mayfair Gardens and the right to take utilities such as water, electricity and gas.

Exceptions and Reservations

The second schedule of the covenant covers exceptions and reservations to the first schedule (Grant of Easements).

Stipulations to be observed and performed by the Transferee

The third schedule applies to owners of properties.

In addition to the stipulations about use and maintenance of properties, owners are required to adhere to the colour conformity so that a consistent and standard level of quality and appearance is maintained.

The Management Company’s Obligations

The fourth schedule covers the obligations of the management company.

This includes the management, maintenance, upkeep of the gardens and common parts of the Mayfair Gardens estate.

Deed of Covenant

The fifth schedule is the deed of covenant, signed by the purchasers and the management company.
